Early Life

Marco Antonio Marques da Silva is a native of São Paulo and was born in ltapetininga on December 31, 1958. From even an early age he knew that he wanted to pursue a career in the field of justice, so when he was ready to go to university, he chose to study law at Pontifical Catholic University of São Paulo (PUC-SP). He graduated from PUC-SP law school in 1981, and would later to go on to earn both a masters degree and a doctorate in criminal procedural law from the same institution. He later continued his education with a post-doctoral degree in economic and European criminal law earned from the University of Coimbra.

Aside from his educational pursuits, his early career was spent in a variety of positions in the field of law, some of which were held concurrently to his time in academia. He began this formal carer as a member of the state judiciary, a post which would see him travel to many different counties in his state in order to carry out his official obligations. Some of the counties in which he worked included Monte Alto, Diadema, and São Paulo. Following his time in this professional area, he would be promoted to serving as a substitute judge. After proving himself in that position, he would go on to be named as a full member of the Court of Appeals.


Beyond the court

Aside from his role on the court, the respected justice has an extensive career as an academic as well. To this end, he has long served as a professor at PUC-SP and has lectured on many different subjects related to the field of law. He is also a member of numerous organizations dedicated to the pursuit of higher learning. Examples of these organizations include the Scientific Council of the Lisbon Law Review, the Center for Legal Research of Cyberspace, and the Scientific Committee of “Interpretatio Prudentium – Roman Law and Romanian Tradition in Review,” at the Research Center of the University of Lisbon (Documentacao).


Books and texts

As is often the case in academia, the judge couples his professorial accomplishments with the authorship of numerous texts related to his field. However what sets him apart in this area is the sheer volume and quality of the books he has written over the years. At present, he has authored fourteen books, a number that would be impressive for any professor, let alone one who also serves as a chief judge.

Da Silva’s books have ranged in topic, with the most recent text being titled “Right to Truth, to Memory, to Forgetfulness,” which was published in 2018 by the Academic Association of the Faculty of Law of Lisbon. One example of a text for which he has become well-known is his 2009 book, “Luso-Brazilian Treaty ofHuman Dignity.” For his work on that book he was awarded the Light of Recognition from the University of Lisbon as well as the Medal of Honor from the Faculty of Law of the University of Lisbon. These awards were presented in recognition of his support of and commitment to Luso-Brazilian legal cooperation. The awards were unanimously approved by the Scientific Council of the Faculty of Law of the University of Lisbon.


Decisions and recognition

Many of the decisions rendered by the judge have helped to set or build upon legal precedent throughout the country. Such actions are often considered the mark of a thoughtful and well-learned jurist as it takes a commanding understanding of the law and legal system in order to build upon past decisions. One example of this is a case in which the public prosecutor’s office was using an illegally-obtained recording from a wiretap in order to seek a guilty verdict in the arrest of two traffickers. Since the wiretapping was performed by the prosecutor’s office, the judge found that it was inadmissible as evidence, stating that wiretapping was under the purview of law enforcement rather than prosecutors. As has been done with other decisions he has handed down, the judge’s ruling, in this case, will be used to set jurisprudence for cases in the future.

The respect that comes with actions such as the above example has also provoked institutions to recognize the judge for his numerous achievements. One occurrence of this was in 2007 when the president of the University Center of Faculdades Metropolitanas Unidas awarded him the title of Doctor Honoris Causa. This honor was bestowed in order to recognize the intellectual and ethical manner in which the judge executes his duties carried out in the protection of the general citizenry and well-being. Such a high honor is rare and is only bestowed on individuals who have been able to truly influence their community and profession through their actions.
